1 Acceptance of Terms

By using the Capital Power website (capitalpower.sa), contacting us for services, or entering into any agreement with us, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy.

If you are entering into these terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.

2 Services Provided

Capital Power provides the following services, subject to these Terms and Conditions:

• Sale of new and certified pre-owned generator sets from authorized international brands.
• Short-term and long-term generator rental with delivery, installation, and support.
• Preventive and corrective maintenance contracts for generator sets.
• Supply of genuine OEM spare parts and consumables.
• Engineering consultations and technical support.

The specific terms of any engagement — scope, timeline, pricing, and deliverables — are defined in the applicable Purchase Order, Service Contract, or Rental Agreement.

3 Quotations & Orders

All quotations issued by Capital Power are valid for 14 days from the date of issue, unless otherwise stated. Prices are subject to change without prior notice after the validity period.

An order is considered confirmed only upon receipt of a signed Purchase Order or written acceptance from the client and the required advance payment where applicable.

4 Payment Terms

Unless otherwise agreed in writing, the following payment terms apply:

• Generator sales: 50% advance payment upon order confirmation, 50% prior to delivery.
• Maintenance contracts: Full contract value payable annually in advance, or as agreed in the contract schedule.
• Rental: Monthly rental invoices due within 7 days of invoice date. Security deposit required prior to delivery.
• Spare parts: Full payment upon order confirmation for non-account customers.

Late payments may be subject to a late payment charge of 1.5% per month on the outstanding balance, in addition to recovery of collection costs.

5 Rental Terms

The following terms apply to all generator rental engagements:

• The client is responsible for providing a safe, accessible, and suitable installation site for the generator.
• The client must not tamper with, modify, or attempt to repair the rented equipment. All maintenance remains the responsibility of Capital Power.
• The client is liable for any damage to the equipment caused by misuse, neglect, or unauthorized modification.
• Upon termination of the rental period, the client must make the equipment available for collection within 48 hours.
• The security deposit will be refunded within 14 business days following return and inspection of the equipment, subject to any deductions for damage or outstanding charges.

6 Warranties & Liability

New generator sets sold by Capital Power are covered by the original manufacturer's warranty as specified in the product documentation. Warranty terms vary by brand and model.

Capital Power's liability under any contract or arrangement is limited to the value of the services or goods supplied under that specific contract. We shall not be liable for indirect, consequential, or loss-of-profit damages.

7 Intellectual Property

All content on the Capital Power website — including text, graphics, logos, images, and software — is the property of Capital Power or its content suppliers and is protected by applicable intellectual property laws. Unauthorized reproduction or distribution of any website content is strictly prohibited.

8 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from these terms or any service agreement shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, Saudi Arabia.

9 Changes to Terms

Capital Power reserves the right to update or modify these Terms and Conditions at any time. Changes will be effective upon posting the revised terms to this page with an updated date. Continued use of our services after any changes constitutes acceptance of the new terms.
